Family law
How we help / Family law
Family law, without the drama.
Whatever your situation, we can help.
What we help with
Parenting arrangements
Where the children live, time with each parent, school holidays, relocation and changing existing orders.
Property settlement
Dividing the house, savings, debts and super, for married and de facto couples.
Consent orders & agreements
Turning what you've agreed into something binding: consent orders or a binding financial agreement.
Mediation
We prepare you for and attend family dispute resolution, including Legal Aid mediations.
Family violence & safety
ADVOs, and making sure any arrangements for the children keep everyone safe.
Court, if it comes to that
Applications and responses in the Federal Circuit and Family Court, from first return to final hearing.
What usually happens
Every family is different, but most matters follow a similar path. Most never reach a final hearing.
- 01 First conversation We listen, explain where you stand and check whether Legal Aid could help.
- 02 Negotiate We write to the other side and try to reach agreement, sharing financial information where needed.
- 03 Mediation Usually required before a parenting case can go to court, unless there are safety concerns or urgency.
- 04 Make it official Consent orders if you agree, or a court application if you can't.
Watch the time limits for property
If you want the court to divide property, you generally need to apply within:
- 12 months after your divorce takes effect, if you were married
- 2 years after you separated, if you were in a de facto relationship
Missed it? It may still be possible with the court's permission, so talk to us early.
Legal Aid for family law
Legal Aid NSW funds many parenting matters and mediations, and some property matters. We do a lot of this work and can help you apply.
Check if you might qualifyCommon questions
Do I have to go to court?
Usually not. Most families reach agreement through negotiation or mediation, and we can make that agreement legally binding.
How much will it cost?
It depends on the matter. We'll give you an estimate in writing before we start, and check whether you're eligible for Legal Aid. See our rates.
The other parent has a lawyer and I don't. What now?
Get in touch and we'll explain your options, quickly if there's a deadline.
What should I bring to our first appointment?
Any court papers, letters from the other side, existing orders or parenting plans, and a rough list of assets and debts.
